Forum

Forum’ refers to the jurisdiction in which an offence can be prosecuted.  The ‘forum bar’ permits a UK court to refuse extradition for an offence which could also be prosecuted in the UK if, having regard to specified factors such as where the majority of loss or harm occurred, the interests of victims, any delay that might result from proceeding in one jurisdiction rather than another and the requested person’s connections to the UK, it would not be in the interests of justice for extradition to take place.
