On 11 July 2015, it was reported that the Ministry of Justice in Taiwan is still attempting to extradite Zain Dean from the UK, in relation to a conviction for manslaughter and related offences, committed in 2010. Reports are here and here. A previous blog is here.
It has been reported that the British government has requested that the Ministry of Justice in Taiwan commute the four years’ sentence of imprisonment, imposed on Mr Dean, on the basis of time served by him in prison in the UK.
Under Taiwan’s Prison Act, Mr Dean is entitled to apply for parole after two years and eight months, according to the Ministry of Justice official cited in the report.
Mr Dean has been in custody in Scotland since 17 October 2013, and a hearing before the Court of Criminal Appeals in Scotland is fixed for September 2015, which will take his time served in the UK close to the Taiwan parole application threshold.
Officials are reported as stating that, should Mr Dean’s length of imprisonment reach this threshold, authorities in the UK may release him, irrespective of the outcome of his appeal before the Court of Criminal Appeals in Scotland. The basis on which this would take place is not stated.
