On 18th September 2018, the Spanish High Court in Madrid, rejected a second extradition request from Switzerland for Herve Falciani. Mr Falciani was sentenced to 5 years’ imprisonment after being convicted of obtaining data illegally and of breaching bank secrecy laws, a crime in Switzerland known as ‘aggravated financial espionage.’ You can find our previous coverage of this case here.
Mr Falciani’s extradition was rejected due to a lack of dual criminality because the Spanish Criminal Code does not include any offence which is the equivalent to the Swiss crime of ‘aggravated financial espionage.’ The request was also identical to a previous extradition request rejected in 2013.
This ruling can be appealed within three days.
