In many cases where the courts consider that there is a real risk of a Requested Person’s human right’s being breached were they to be extradited, the Requesting State will offer an assurance to the contrary. For example, in a case where prison conditions in the Requesting State would breach the Requested Person’s Article 3 rights, the Requesting State may assure the UK authorities that the Requested Person will serve his or her sentence in an Article 3 compliant facility.
